Changessuggestedtoaligncurrentlawwithcurrentthreats: v Allowstatementsbynon-citizenssupportingShariatobeusedasgroundsfor exclusion v Amendlawtoprohibitentrytothosewhorejectthesupremacyofthe U.S.Constitution v Banmembersofgroupsthathavetheavowedgoalofreplacingor subordinatingtheU.S.Constitution 1 STOPIMPORTINGJIHADISTS-ASecureFreedomStrategypaper MAKING SHARIA-SUPREMACISM A BAR TO IMMIGRATION AND NATURALIZATION TheUnitedStatescannotlongsurviveifitinvitesintoitsmidstnon-citizenswhoare fundamentallyopposedtoourConstitution,thegovernmentitestablishedandthe freedomsitguarantees.Previousgenerationsunderstoodthisrealityandcodified intolawgroundsforexcludingNazis,Communistsandothersbentonestablishinga totalitariansysteminplaceofourrepresentativedemocracyfromenteringthis countryandbecomingnaturalizedcitizens.ThecurrentthreatposedbytheGlobal JihadMovementanditsanimatingdoctrine,Sharia,canandshouldbeaddressedby thesesamerestrictions. TwotypesofactivitybySharia-supremaciststhatshouldprecludeentrytotheU.S. areviolence,commonlyknownasterrorism,andsubversiveactsaimedat underminingandultimatelyoverthrowingoursystemofgovernment.Terrorist activityisgroundsforexclusionbasedpurelyonitsviolentnature. Pre-violentSharia-supremacistspreparedtoengageinsubversionshouldalsobe bannedbasedonthegoalthesegroupsandindividualsalsohaveofsupplantingthe U.S.ConstitutionandsystemofgovernmentwiththetotalitarianIslamiccodecalled Sharia.Manysucheffortsarebaseduponalongterm,incrementalstrategyfor stealthilyinsinuatingShariagloballyand,therefore,eachsteponitsowncaneasily bemistakenlyperceivedasunobjectionable. CurrentstatutesdoallowSharia-supremaciststobevettedandbannedfromentry, butshouldbeamendedtocodifytheprohibitionfromentryofthesenon-citizens whodonot,andcannot,faithfullysupportthebasictenetsoftheU.S.Constitution. BurdenofProof Itiscriticallyimportanttobearinmindthatimmigrationisnotacriminaljustice issueandpotentialimmigrantsdonothavethesamerightsascitizens.Theburden mustbefullyplaceduponapotentialimmigranttoshowthatheisnotathreat,not ongovernmenttoproveheisone.Inanyindividualcase,theexecutivebranchhas discretiontokeepanalienout,andthisexerciseofdiscretionshouldnotbe reviewablebythecourtsbecause: (a)aliensdonothavejudiciallyenforceablerights; (b)theConstitutionmakespoliticalbranchessupremeinmattersofnational securityandimmigrationenforcement; 2 STOPIMPORTINGJIHADISTS-ASecureFreedomStrategypaper (c)theConstitutionassumesthatimmigrationenforcementisapoliticalratherthan alegalissueinthesensethatthecheckongovernmentpolicyistheballotbox,not lawsuitsbroughtbyaliens; (d)anylegitimateFirstAmendmentinterestofAmericanstoheardissentfrom,and associatewithaliens,ismorethanadequatelysatisfiedbymoderncommunications technology,withouttheneedforthealientobephysicallypresentintheU.S.;and (e)aslongasthereisnocategoricalbanonMuslimsinplace,anyconceivabledue processrequirement(assumingonlyforargument’ssakethatthereissucha requirement)ismorethansatisfiedbyanindividualizedvettingprocessinwhich thealienisgiventheopportunitytoprovethathe/sheisnotathreat. Decisionsbyexecutiveagenciestoexcludesharia-adherentindividualsshouldbe unreviewable.Decisionsbythemtoadmitindividualswhomaybeobscuringtheir adherencetoShariashould,however,bereviewablebyotheragenciesandcourts. Regardlessofanyotherauthority,thePresidentmaybansharia-adherent individualsbasedonexecutiveauthoritygrantedin8U.S.Code§1182- Inadmissiblealienssection(f): (f)SuspensionofentryorimpositionofrestrictionsbyPresident WheneverthePresidentfindsthattheentryofanyaliensorofanyclassof aliensintotheUnitedStateswouldbedetrimentaltotheinterestsofthe UnitedStates,hemaybyproclamation,andforsuchperiodasheshalldeem necessary,suspendtheentryofallaliensoranyclassofaliensasimmigrants ornonimmigrants,orimposeontheentryofaliensanyrestrictionshemay deemtobeappropriate. ThepastsixPresidents,includingthecurrentone,haveallusedthisauthoritytoban certainclassesofpeoplefromentry.Giventheimmediateandongoingthreatposed bySharia,allavailablemeanstostopentrybyindividualswiththegoalof underminingtheU.S.Constitutionshouldbeused. ShariaAdherenceistheKey Adividinglinecanandshouldbedrawnthatdoesnotautomaticallyexcludeall MuslimsfromentryintotheUnitedStates.Wehavenumerousallieswhowouldlose theirabilitytotravelhereandtherearemanyMuslimswhodonotposeathreatand havedonenothingtodeserveabanonentry.Theproperdifferentiatoris their adherenceand/orattachmenttothetotalitarianShariadoctrine. ShariaisderivedfromIslam’sreligioustextsandexplicitlyrequiresadherentsto supporttheestablishmentofasocietybaseduponitstotalitariancode.Whilethis politico-military-legalsystemhasapatinaofreligiosity(includingprayers,abelief inasupremebeing,ritualpractices,communityworship,etc.),itisstillproperly 3 STOPIMPORTINGJIHADISTS-ASecureFreedomStrategypaper definedasatotalitarianideology.AdherencetoShariarequiressupportforand activeworktoachievethedestructionorsubordinationofboththeU.S.Constitution andthenationalexistenceoftheUnitedStatesofAmerica. ShariaincludesadoctrineofconquestknownasJihad,whichisacentralfeatureof itslawsandrequirements.JihadandShariaareinextricablylinked,withSharia formulatingandcommandingJihad,andwithJihadbeingwagedforthepurposeof imposingandinstitutingSharia.AdherencetoShariaisadherencetothelegal, political,andmilitarydoctrinesandlawofJihad.TheultimateaimofJihadisthe impositionofShariaonallnations,includingtheUnitedStates. ShariaDefinitionforthepurposeofU.S.Code ThemainstreaminterpretationofShariabytheauthoritiesofIslamisthe totalitarianversionaimedatenforcedimpositionworldwide.Thisbeliefsystem, especiallyitsdominationofallaspectsoflife,isnotsharedbyallMuslims.The UnitedStateshasanationalsecurityinterestintruly“modern”(i.e.,post-Sharia) MuslimsprevailingintheinternecineIslamicdebate. Therefore,itisnecessarytorepudiateexpresslytheanti-constitutionaltenetsof politicalIslam’sconstructionofSharia(e.g.,unequaltreatmentunderthelaw,antidemocraticgovernancestructure,denialofFirstAmendmentfreedoms,etc.)in order,amongotherthings,tohelpthosemoderatesmarginalizetheextremistswho threatenusall. TheimpositionofShariaisaccomplishedusingbothviolentmeans,non-violent techniques,includingsubversion,andinsomecaseslawfulones(e.g.,immigrationfueledpopulationgrowth).Irrespectiveoftheapproachemployed,thegoalisthe same:increasingthepoliticalinfluenceandpowerofSharia’sadherents.Adherence toandadvocacyforSharia-adherenceisasignificantindicatoroflikelycommission ofmaterialsupportforandactualactsofterrorism. Shariamustbeconsideredatotalitarianideologyforthepurposesofthe ImmigrationandNaturalizationAct.Inlightofthesefacts,theadmissionintothe UnitedStatesandnaturalizationascitizensofindividualswhoadheretoSharia posesclearandpresentdangerstotheU.S.Constitution,thiscountryanditspeople, andshouldbeprecluded. ApplicableU.S.LawAuthorizingEntryBansandSuggestedModifications ThecurrentImmigration&NationalityAct(INA)haslanguagethatprovidesabasis fordeterminingthatSharia-adherentsandmembersofgroupswiththeavowedgoal ofimposingShariashouldbebannedfromentry.Thisisbasedonthedetermination thatShariaisatotalitarianideologyincompatiblewiththeU.S.Constitutionandthat 4 STOPIMPORTINGJIHADISTS-ASecureFreedomStrategypaper itsavowedgoalistoreplaceoursystemofgovernancewithatotalitariansystem basedonSharia’sdictates. DefiningTotalitarianism Thecurrentdefinitionoftotalitarianforthesepurposesisin8U.S.Code§1101– Definitions: (37) Theterm“totalitarianparty”meansanorganizationwhichadvocatesthe establishmentintheUnitedStatesofatotalitariandictatorshipor totalitarianism.Theterms“totalitariandictatorship”and“totalitarianism” meanandrefertosystemsofgovernmentnotrepresentativeinfact, characterizedby(A)theexistenceofasinglepoliticalparty,organizedona dictatorialbasis,withsocloseanidentitybetweensuchpartyanditspolicies andthegovernmentalpoliciesofthecountryinwhichitexists,thattheparty andthegovernmentconstituteanindistinguishableunit,and(B)theforcible suppressionofoppositiontosuchparty. Thisdefinition,whichwaswrittentoprovideabasisforexcludingmembersof totalitarianpoliticalpartiesshouldbeamendedsoastopermitittocaptureaswell adherentstoatotalitarianideology,includingonethathasreligiouselements (yellowhighlightedtextcontainssuggestedrevisions): (37) Theterm“totalitarian”referstoindividuals,ideologiesandorganizations thatadvocatetheestablishmentintheUnitedStatesofasystemof governmentnotrepresentativeinfact,characterizedby(A)absolute submissiontoasupremepoliticalauthorityoraparty,thatisorganizedona dictatorialbasis,withsocloseanidentitybetweensuchpartyanditspolicies andthegovernmentalpoliciesofthecountryinwhichitexists,thattheparty andthegovernmentconstituteanindistinguishableunit,and(B)theforcible suppressionofoppositiontosuchparty. Theseprovisionscanandshouldbeusedwithguidancefromtherelevantexecutive branchagenciestoprohibitentrybasedontheattributesofShariaidentifiedabove. ThecriteriaforestablishingSharia-adherenceforpurposesofrestrictingentry shouldbesimilartothoseusedpreviouslytoexcludepractitionersofCommunism andothertotalitariandoctrines. 8U.S.CodeSection1182(3)(C)(iii)shouldbeamendedbyaddingthefollowingatits end(thecurrentExceptionforOfficialsC(ii)relatingtodiplomatsandlegal representativesofothergovernmentswouldremain): AnyalienwhotheconsularofficerortheAttorneyGeneralknows,orhas reasonablegroundstobelieve,rejectsthesupremacyoftheUnitedStates Constitution,includingthelawsandregulationsenactedandthecommon lawjudiciallydevelopedpursuanttoit,asthesolegoverninglegalauthority or otherwiseseekstolimitthatsupremacyasthesolegoverninglegal authoritywithinthejurisdictionoftheUnitedStatesisinadmissible. ChangesshouldalsobemadetoaprovisiongrantingdefactoextensionofU.S. FirstAmendmentprotectionstonon-citizensseekingentry:8U.S.CodeSection 1182(a)(3)(C)(iii).Thestatements,beliefsandassociationsofanyoneattemptingto entertheUnitedStatesshouldcertainlybeopentoscrutinyandpotentiallycause exclusioniftheyevinceanattachmenttoananti-constitutionalideologylikeSharia. Non-residentaliensoutsidethecountryshouldhavenoexpectationofFirst AmendmentoranyotherrightsguaranteedbytheU.S.Constitution.Therefore,the sectionentitled“Exceptionforotheraliens”highlightedbelowshouldberepealed (redhighlightedtexttoberemoved). Theseprovisionsascurrentlyenactedprovidegroundsfordenialofnaturalization basedonthepracticeofSharia.ThecurrentlawdirectlynamesCommunismasa prohibitedtotalitariandoctrine.Itshouldbeamendedtocoveranytotalitarian doctrinethatadvocatessupplantingtheU.S.Constitution.Membershipingroups thatrequireactiveeffortstoreplaceexistingU.S.lawandgovernmentwithSharia andpropagatingmaterialsadvocatingthisanti-constitutionaldoctrineshouldalso begroundsfordenyingnaturalization. 8U.S.Code§1424(4)(A)shouldbeamendedasfollows: (4) whoadvocatesorteachesorwhoisamemberoforaffiliatedwithany organizationthatadvocatesorteaches(A)theoverthrowbyforceor violenceorotherunconstitutionalmeansoftheGovernmentoftheUnited Statesorestablishedformsoflaw 8U.S.Code§1424(5)(E)shouldbeamendedasfollows: (E)…theeconomic,international,andgovernmentaldoctrinesofworld Communism,ortheestablishmentintheUnitedStatesofatotalitarianform ofgovernmentwhichsupplantstheU.S.Constitution;or…. Conclusion TheUnitedStatesgovernmentistaskedwithensuringthatanyoneenteringthis countrydoesnotactivelyseektooverthrowoursystemofgovernmentorimpose anotherformofgovernanceincompatiblewiththeU.S.Constitution.Itmustalso ensurethosewhoseektobecomenaturalizedcitizenssharethevaluesenshrinedin thenation’sfoundingdocumentsorbedeniedthatprivilege. TheIslamictotalitarianideologyofShariaisfundamentallyincompatiblewiththe freesocietyandgovernmentenjoyedbyallAmericans.Itcontainselementsof religion,butitsrequirementstomandateallaspectsofprivateandpubliclifefor bothitsadherentsandnon-believersexceedstheboundariesforreligious protectionundertheFirstAmendment.Sharia’sassertionofsupremacyoverall man-madelawsanditsrequirementthatthosewhoattachtoitmustactivelystrive toimposeShariaworldwideconstitutesufficientgroundstoconsiderShariaananticonstitutionaltotalitariandoctrineandrestrictitsadherents’entryand 9 STOPIMPORTINGJIHADISTS-ASecureFreedomStrategypaper naturalizationinaccordancewithexistinglaw.Amendmentscan,however, helpfullyclarifyandeliminatebasesforcontestingthatrestriction. Allexecutivebranchagenciesresponsibleforinternationalandhomelandsecurity andimmigrationshouldbeimmediatelyinformedofthisguidanceforinvestigations anduseindenyingentryandnaturalization.Congressshouldevaluateandenactthe proposedchangestostrengthenthegovernment’sabilitytoscreenoutfromboth entryandnaturalizationnon-citizensholdingandactingonthisanti-constitutional Shariaideology. 10
