H E R E A S t h e p e r s o n s whose n a m e s a r e hereinafter m e n t i o n e d
i n S c h e d u l e A h a v e applied t o conditionally p u r c h a s e c e r t a i n
C r o w n L a n d s u n d e r t h e t h i r t e e n t h section of t h e C r o w n L a n d s A l i e n ­
a t i o n A c t of 1 8 6 1 a n d h a v e resided on a n d i m p r o v e d t h e same a n d
w h e r e a s t h e said l a n d s h a v e been s u b s e q u e n t l y found to be w i t h i n
areas reserved from c o n d i t i o n a l p u r c h a s e o n a c c o u n t of p o p u l a t i o n b y
t h e said t h i r t e e n t h section A n d w h e r e a s t h e p e r s o n s whose n a m e s a r e
mentioned in Schedule B have improved certain unimproved town
lands

A n d w h e r e a s t h e p e r s o n whose n a m e is m e n t i o n e d i n

special p r o c l a m a t i o n from c o n d i t i o n a l p u r c h a s e
A n d whereas the
p e r s o n whose n a m e is m e n t i o n e d i n S c h e d u l e D h a s b e e n declared
t h e conditional p u r c h a s e r of c e r t a i n C r o w n L a n d a n d w h e r e a s t h e l a n d
so p u r c h a s e d is contained w i t h i n a n a r e a w h i c h h a s since b e e n d u l y
d e c l a r e d t o b e set a p a r t as t h e site of a t o w n a n d w h e r e a s t h e said lastm e n t i o n e d p e r s o n agreed t o r e l i n q u i s h t h e l a n d so conditionally p u r ­
chased i n consideration t h a t h e w a s allowed to p u r c h a s e t h e five acres
set opposite t o h i s n a m e i n t h e said l a s t - m e n t i o n e d S c h e d u l e A n d
w h e r e a s i n or a b o u t t h e m o n t h of F e b r u a r y one t h o u s a n d e i g h t h u n d r e d
a n d s i x t y - t w o one G e o r g e D e w d n e y as t h e t r u s t e e of t h e p e r s o n whose
n a m e is m e n t i o n e d i n S c h e d u l e E s u c h p e r s o n t h e n b e i n g u n d e r
c o v e r t u r e applied t o conditionally p u r c h a s e w i t h o u t c o m p e t i t i o n c e r t a i n
u n i m p r o v e d C r o w n L a n d a n d w h e r e a s t h e p e r s o n whose n a m e is
m e n t i o n e d i n S c h e d u l e E a n d h e r h u s b a n d have i m p r o v e d t h e l a n d so
applied for a n d w h e r e a s h e r h u s b a n d is n o w dead A n d w h e r e a s t h e
p e r s o n whose n a m e is m e n t i o n e d i n S c h e d u l e E h a s applied t o con­
ditionally p u r c h a s e w i t h o u t c o m p e t i t i o n c e r t a i n u n i m p r o v e d C r o w n
L a n d h e s u p p o s i n g t h e said l a n d t o c o n t a i n forty acres a n d w h e r e a s
u p o n s u r v e y i t a p p e a r s t h a t t h e said l a n d only c o n t a i n s t h i r t y - o n e
acres a n d o n e rood a n d w h e r e a s t h e person whose n a m e is m e n t i o n e d
i n S c h e d u l e E h a s resided on a n d i m p r o v e d t h e l a n d so applied for
A n d w h e r e a s it is e x p e d i e n t t o sell t o t h e p e r s o n s whose n a m e s are
m e n t i o n e d i n t h e Schedules A B C D E a n d F t h e p o r t i o n s of C r o w n
L a n d s set opposite t o t h e said n a m e s i n t h e said Schedules respectively
a t a n appraised v a l u e a n d t o give t h e r e q u i s i t e a u t h o r i t y for s u c h
p u r p o s e B e it therefore e n a c t e d b y t h e Q u e e n ' s M o s t E x c e l l e n t
M a j e s t y b y a n d w i t h t h e advice a n d consent of t h e Legislative
Council a n d Legislative A s s e m b l y of N e w S o u t h Wales i n P a r l i a m e n t
assembled a n d b y t h e a u t h o r i t y of t h e same as follows :—
1. T h e G o v e r n o r w i t h t h e advice of t h e E x e c u t i v e Council m a y
sell a n d g r a n t t h e several p o r t i o n s of l a n d s m e n t i o n e d i n Schedules A
B C D E a n d F h e r e t o a n n e x e d to t h e respective persons whose n a m e s
are set opposite t o s u c h p o r t i o n s of l a n d s i n t h e said Schedules respect­
ively w i t h o u t c o m p e t i t i o n i n fee simple at a price t o b e fixed b y
a p p r a i s e m e n t i n accordance w i t h t h e provisions of t h e C r o w n L a n d s
A l i e n a t i o n A c t of 1 8 6 1 s u c h price n o t b e i n g less t h a n e i g h t p o u n d s a n
acre for t o w n l a n d s a n d one p o u n d a n acre for o t h e r l a n d s b u t s u c h
a p p r a i s e m e n t shall n o t i n c l u d e a n y v a l u e for i m p r o v e m e n t s .
2. U p o n t h e issue of t h e g r a n t of t h e l a n d m e n t i o n e d i n Schedule
D a n d hereby a u t h o r i z e d t o b e sold a n d g r a n t e d t h e l a n d a g r e e d t o be
r e l i n q u i s h e d shall r e v e r t to H e r M a j e s t y as fully to all i n t e n t s a n d
p u r p o s e s as if t h e s a m e h a d n o t b e e n conditionally p u r c h a s e d .
