The year is moving along quickly. We just
finished up our Winter Workshop in Southern
Pines. Special thanks go out to Larry Odom
and Kevin Medeiros for putting on a well
organized event. I would also like to thank all
the board members for their team work and
dedication during the workshop. We had a
fantastic turn out and a large number of Board
Adjustment members for the morning session,
BOA Do’s and Don’ts. In the afternoon session
we learned how to handle difficult enforcement
issues that we encounter in our work. And of
course Rich and Dave brought us up to date
on the legal issues. Thanks go out to past
President Joy Richards for being our local
person on the scene.
Larry Odom, Certification Committee chairman and I, addressed the opening
of the Certification Course. There were a few “Non-members” in attendance
but hopefully after our encouragement and the knowledge gained from the
course, they won’t be non-members for long. I wish them all the best of luck.
I would like to thank all of the certification committee members for their hard
work over the last several months. A list of our newest CZO’s will be posted
in the summer newsletter. The Introduction to Zoning Course is coming up.
There will be two offerings of the Intro Course this year. May 14th-18th and
June 11th-15th. Get your name in early and remember, the Intro Course is a
prerequisite for being able to take the Certification Course.
Mark your calendars; the summer conference is just around the corner. Loray
Averett and John Evans are putting the final touches on what will be a great
event with interesting topics and speakers. As an added bonus, we will be
at what is clearly one of my favorite places, on the beach. Our location this
year will be at the Shell Island Hotel in Wrightsville Beach, August 12th -15th.
Break out the beach towels and flip flops, we are going have some fun and
learn something while we are doing it. Look for all the details in the up coming
summer newsletter.

Once again, thank you for allowing me to serve. The Association is strong and your Board of Directors
are committed to the continued success and future of your organization. Please remember to visit the
website often and get involved. You do not need to be on a committee to volunteer. There is always help
needed at the workshops and conferences so do not be afraid to ask. Have a great summer and I hope
to see you all at the Conference.

It is with tremendous sadness that we announce the
passing of a valued member of our organization Mr. Archie
Andrews Jr. Archie passed away on January 19, 2007.
Archie was a native of Greensboro and was the Chief
Code/Zoning Enforcement Officer for the City of
Greensboro for 38 years before retiring in 1990. He was
a founding member of the NCAZO and served as our 2nd
President (1982-1983). He was named an Honorary
Member of the NCAZO shortly after his retirement. Our
condolences, thoughts and prayers go out to the family
and friends of Mr. Archie Andrews.

Board of Directors Meeting
The Board of Directors meeting convened at 12:30 p.m. on Tuesday, March 6, 2007 at the Days Inn in Southern Pines. Members
present included Joey Lea, President; Gary Ouellette, 1st Vice President; Geoffrey Pearson, 2nd Vice President; Larry Odom, Treasurer; Loray Averett, Secretary; and Board Members John Evans, Ron Smith, Kevin Medeiros, David Sudderth, and Helen Bunch.
Minutes
President Lea moved to approve the minutes from the October 27, 2006 Board of Directors meeting. Mr. Ouellette seconded the
motion. The motion carried.
Southern Pines Workshop Update and Evaluations
Mr. Odom and Mr. Medeiros gave a final report on the workshop. There were approximately 125 members in attendance, 30 of which
were first time attendees. The workshop evaluation comments were positive. Mr. Sudderth moved to accept the workshop report,
seconded by Mr. Smith. The motion carried.
Policies-Update
President Lea presented a list of previously approved policies that dated back to January 1985. He had requested that each Board
member go over the list of polices so that the policies could be condensed and updated to reflect the current Board operations and
be placed in each director’s book. Mr. Sudderth moved to accept the policy report, seconded by Mr. Medeiros. The motion carried.
Annual Conference Report
Ms. Averett and Mr. Evans gave a preliminary update for the 2007 annual conference. The location will be at Shell Island Oceanfront
Suites in Wrightsville Beach. The registration fee for members has been preliminarily set at $125.00. Mr. Ouellette moved to accept
the annual conference report, seconded by Mr. Smith. The motion carried.
Certification Committee Report
Mr. Pearson gave the certification committee report. There will be two Introduction to Zoning Courses and a Certification Course this
year. The Certification Course is planned for March and April, and Introduction to Zoning Courses planned for May and June. Mr.
Pearson invited the Board members to visit and support the attendees during courses. Mr. Sudderth made a motion to approve the
report, seconded by Ms. Bunch. The motion carried.
Treasurer’s Report
The financial report was given by Mr. Odom. He submitted an updated treasurer report for current records. The current checking
balance is $24,707.57. The CD money market account balance is $17,799.03. President Lea moved to accept the report, seconded
by Mr. Ouellette. The motion carried.

Membership Report
Mr. Evans gave the membership report. The report shows the Association has 463 members (11 honorary members) of which 382
have paid their membership dues. Seventy (70) members have not paid their dues and any unpaid will be dropped from membership
at the end of 2007. There have been 81 new members this year, as of March 2, 2007. Mr. Evans submitted a graphics chart that
shows the membership growth from 2004 through this date of March 2007. This chart reflects that membership has been increasing
each year for the past four years. There are some counties that still do not have representation and Mr. Evans noted that he will send
these counties a brochure along with a welcome to zoning letter. Mr. Sudderth moved to accept the membership report, seconded
by Mr. Medeiros. The motion carried.
Education/Publicity Report
Mr. Ouellette and Mr. Medeiros presented the education/publicity reports. Mr. Ouellette stated the spring newsletter will be published
on March 30, 2007 and asked for all newsletter items by March 15th. Mr. Ouellette explained to the Board members how the
newsletter is formatted. President Lea suggested that each member receive a copy of the newsletters via email along with the
website address. Mr. Pearson and Mr. Medeiros made mention of other technology that the website could benefit from. Mr. Pearson
made a motion to accept the report, Ms. Bunch seconded. The motion carried.
Legislative report
Ms. Bunch reported that the Legislative report was given by Dave Owens during the workshop and that their presentations would be
put on the website. Mr. Evans made a motion that the report be accepted, seconded by Mr. Smith. The motion carried.
The next Board of Directors meeting date will be May 18, 2007.
Mr. Ouellette made a motion to adjourn, seconded by Mr. Smith.
With no further business, the meeting adjourned at 4:00.

Our Mid-Winter Workshop in Southern Pines was a great success. We had a tremendous attendance,
119 participants of which, 30 were first time attendees and 14 Board of Adjustment members from the
local area. Monday morning started with opening remarks from our President and a Welcome to the
area from the Mayor Pro-Tem of Southern Pines, Mr. Fred Walden. A newcomer on our list of presenters,
Misty Woodard, Attorney for the City of Wilson, spoke about the Do’s and Don’ts of the Board of
Adjustment. There was a lot of great information, much discussion and we all know where to get some
quality fresh roasted coffee beans (even if the neighbors don’t like it.). We engaged in some good
exchange of enforcement situations early in the afternoon and then Mark Payne, Johnston County Attorney,
discussed enforcement, trespass, search and investigation. This too was great information that will
assist us all in being better zoning and code enforcement officials. Tuesday opened with Dave Owens
presenting a Legislative Update bringing us all in the loop on the activities of the General Assembly and
what will impact us. Rich Ducker followed with situations that challenged our knowledge of the laws,
enforcement, and legal procedures. Throughout the course of the workshop, there were many friends
made, knowledge shared and valuable networking took place. Larry Odom and Kevin Medeiros who
co-chaired the workshop did a fantastic job and are to be commended and congratulated on a great
event. Thanks to all the participants who made the workshop a success and your input on topics, speaker
recommendations and locations for future educational opportunities.

Annual Conference Update
As our Association enters its second quarter of a century, we hope you can join us for our NCAZO
Annual Conference on the beautiful shores of Wrightsville Beach. The conference will be held at the
Shell Island Oceanfront Suites August 12th through the 15th. We have a fantastic event planned
with educational opportunities and the chance for you to interact with your colleagues in an oceanfront
atmosphere. Some of the events tentatively scheduled include sessions on customer service specifically
tailored to zoning enforcement and administration officials, regulating correctional facilities (from the
perspective of those who manage correctional facilities), Board of Adjustment issues, and much more.
During our Annual Awards Banquet, you can participate in a festive variety of music and entertainment.

you plan your budget, the conference registration for members is tentatively set at $125.00. Final
registration information will be included in the Summer Newsletter. We know you will enjoy the events we

Introduction To Zoning Courses: The School of Government is offering two sessions
of the Introduction to Zoning Course this year. The course dates are May 14th – 18th
and June 11th – 15th. Contact Beverly Howarth at [email protected] for enrollment

Board of Directors Meeting: The Board of Directors will meet on Friday, May 18th.
Contact any of your board members if you have something you feel the Board needs
to address.
Newsletter Articles: The deadline for submission of articles for the next newsletter

2007Annual Conference: The Annual Conference will be held at the Shell Island

Certification Committee Update
The NCAZO Certification Committee met on March 3, 2007 at the Mid-Winter Workshop held in Southern
Pines. The committee met to discuss the upcoming Certification Course which is to be held in Chapel
Hill on March 12th – 15th, and April 10th – 12th. The committee presented potential exam questions for
the course, as well as reviewed the roster of registered participants. There are approximately 44 students
who are registered to take the course and exam. We wish these individuals good look as they pursue
CZO Certification.

LET’S GET EDUCATED (a continuing series)
“Quasi-judicial Zoning Decisions”
Whether your jurisdictions Boards of Adjustment meet regularly and here many
cases or infrequently and only hear variances and zoning interpretations here is some good information on
quasi-judicial zoning decisions.
Special rules apply to all decisions where there is fact-finding and the application of discretionary standards. This
includes appeals, variances, special use permits, and conditional use permits. While these decisions are typically made by
boards of adjustment, they may also be assigned to the planning board or governing board.
Quorum and voting. The statues do not set a special quorum for boards. Some ordinances specify a majority of
board; others use a higher four-fifths requirement. Many decisions of the board of adjustment require a four-fifths majoritysuch as granting a variance, a special or conditional use permit, or overruling a determination of the zoning administrator.
Vacant seats and members who are excused from voting due to a conflict of interest are not considered in computing the
majority if there are no alternates to replace them.
Hearings. An evidentiary hearing is required for each decision. The purpose of the hearing is to establish the facts,
not to gather opinions about the desirability or popularity of the project. Witnesses present testimony under oath, crossexamination must be allowed, board members are not allowed to gather evidence outside of the hearing, and written findings
of fact are required.
Notice of hearings. A local government must give due notice of its hearings to all parties to the case. Individual
mail notice is the usual method of doing this. The zoning statutes impose no special published notice requirements for
quasi-judicial decisions (unlike proposed zoning amendments). If a zoning ordinance itself requires additional notice, such
as publication in the newspaper or a sign on the site, that additional notice is mandatory. The open meetings law also has
requirements for meeting notices that apply.
Witnesses. Persons presenting testimony are subject to several requirements. Everyone presenting evidence
should do so under oath. Oaths may be waived, but it is best to use oaths or affirmations for everyone. This applies to
anyone offering evidence, including staff and attorneys. Cross-examination of witnesses must be allowed.
Evidence. Quality evidence must be in the hearing record to support all of a board’s key conclusions. The legal
standard is that substantial, competent, material evidence is required to be in the record for each key fact. While strict legal
rules of evidence do not apply, they are a general guideline for boards. Hearsay and non-expert opinion should be avoided.
Determining how much weight should be given to the evidence that is offered is a key job of boards of adjustment. No exparte communication should be allowed-only evidence in the record at the hearing may be considered. Site visits prior to the
hearing are permissible, but care should be taken to avoid conversation with applicant/neighbors and any critical information
obtained on site must be disclosed at the hearing.
