Introduction
1.1.
This study was commissioned by the St. James’s Conservation Trust to consider the
spread and growth of licensed A3 (restaurant, cafe), A4 (pub, wine bar), A5 (hot food
shop) and other licensed premises and their impact on the character of St. James’s. To do
so, it provides an update of licensed premises databases compiled in 1999 and 2005 and
an assessment of the changes in the quantity, distribution and potential impacts of
licensed premises within the study area.
Recent History
1.2.
In Westminster generally the growth in entertainment uses has been associated with
increases in crime and disorder, anti-social behaviour, noise and pressure on Council
services.
1.3.
The 1999 study ‘Conserving Historic St. James’s’1 attributed the area’s special character
partly to its mixed specialist uses and activities. It found these to be under threat from the
growth in licensed food and drink uses, connected with what it described as a “seemingly
unstoppable increase” in the number of food and drink uses throughout London generally
and the spread of such uses westwards from the West End Stress Area.
1.4.
The 2005 study ‘St James’s A3-Food and Drink Study’2 found evidence supporting the
idea that the West End Stress Area had reached a point of saturation with food and drink
uses. The proportion of food and drink uses granted consent between 1990 and 2005
within St. James’s was greater than within the Stress Area. This was taken as evidence
that policies to control the growth of these uses in the West End Stress Area were placing
enormous pressures on the St. James’s area, leading to a growth of licensed uses
threatening its distinct, historic character. The study warned that, without effective action
to regulate growth, the further proliferation of entertainment uses going forward would
eradicate the remaining traditional character of St. James’s.

Method
2.1.
An up to date database of licensed premises was prepared using the 2005 study’s
database as a starting point. The database was updated through desk-based research
using Westminster City Council’s licensing register and an on-site survey visit undertaken
in November 2015. The database is provided as 4.2.Appendix A.
Use Classes
2.2.
2.3.
The previous studies primarily covered licensed food and drinks premises falling under
The Town and Country Planning (Use Classes) Order 1987 Class A3 Food and drink:
'Use for the sale of food or drink for consumption on the premises or of hot food for
consumption off the premises'. The 2005 study noted that the preceding 10 years had
seen an increasing blurring of use classes, such as the distinction between Class A1
(shops) and Class A3 (food and drink), with licences increasingly extended to premises of
the former category. Establishments such as sandwich bars were seen to have
increasingly taken on characteristics of – and consequently produce similar impacts to –
food and drink uses. Furthermore, changes in the type of premises such as from
restaurant to bar (both Class A3) could have a significant impact on the character of the
local area despite not being recorded as a change in Use Class. In this way, the definition
of uses was considered to neglect the potential impact of premises on amenity.
The General Use Classes Order has been amended since the original study – most
recently in 20153 - such that premises previously covered by Use Class A3 are now
divided between Classes A3, A4 and A5 as follows:

Class A3: Restaurants and Cafes: 'Places where the primary purpose is the sale and
consumption of food and light refreshment on the premises'
Class A4: Drinking establishments: 'Premises where the primary purpose is the sale
and consumption of alcoholic drinks on the premises: Public House (A4), Wine bar or
other Drinking establishment'
Class A5: Hot food takeaways: 'Premises where the primary purpose is the sale of hot
food for consumption off the premises'.
2.4.
The new distinction between A3, A4 and A5 Use Classes enables a more nuanced
consideration of the amenity impacts of premises. As such, the analysis presented here
discerns between the three Use Classes according to the 2015 definitions.
2.5.
The previous studies also incorporated licensed premises falling under other Use Classes
which have the potential to affect St James's historic character: hotels (C1) and private
members clubs and nightclubs (sui generis). Accordingly, these are included in the
updated database. Class A1 (shops) premises were not included in the 1999 and 2005
databases, despite the recognition in 2005 that they increasingly had amenity impacts
(Paragraph 2.2). A1 licensed premises are included in the 2015 database, however due to
their exclusion from the previous studies it is not possible to make comparisons or to
measure change over time.

Study Area
2.6.
This report refers to two study areas: the 1999 study area and the 2005/2015 study area
(‘St James’s Conservation Trusts’ Area of interest 1999’ and ‘Study Area’ in Figure 2-3,
respectively). The scope of the study was expanded in 2005 to comprise the area
bounded by Green Park, the Mall, Piccadilly and Haymarket. This remains the study area
for the updated database. For purposes of valid comparison, changes since 2005 are
assessed across the wider study area whilst changes since 1999 are assessed only in
reference to the original study area.
Opening Hours
2.7.
Licensed opening hours were compiled from the 1999 study licence database and
Westminster City Council’s licences register. It must be noted that opening hours stated
on the licence may not reflect the actual opening hours chosen by the premises. Rather,
they provide a maximum impact scenario of licensed opening hours of premises in the
area.
2.8.
Comparison with 2005 could not be conducted owing to the patchiness of the 2005
opening hours data and the fact that data, where available, generally reports premises'
actual opening hours rather than licensed hours. Therefore analysis of changes in
opening hours is limited spatially to the 1999 study area.

3.
Findings
Types of Licensed Premises
3.1.
The dominant type of licensed premises in St James’s is Class A3 (restaurant/bars and
cafes), numbering 61. Of these, 58 are restaurant/bars. There will also be several new
premises likely to fall under this category located in the St James’s Market development
(Haymarket/Regent Street St James’s) when complete. In other licensed uses, there are
13 Class A4 premises (six public Houses, seven bar/wine bars), seven C1 hotels, 22
private members clubs and two nightclubs (sui generis Use Class) in St James’s.
3.2.
Table 3-1 summarises the changes in licensed premises since 1999 and 2005.
3.3.
In addition, there are seven Class A1 (shop) licensed premises, including wine merchants,
cigar shops and Tesco. Three of the shops are licensed for on premises consumption of
alcohol – evidence of increasing convergence of A1 uses towards A3/A4.
3.4.
11 licensed premises in St James’s have an outdoor Tables & Chairs Licence. With the
exception of the Blue Posts Public House (Bennet Street), all premises possessing this
licence are A3 restaurant/bars and cafes.
Change Since 1999
3.5.
3.6.
Within the 1999 study area, the overall number of licensed addresses has increased from
54 to 61. The majority of this increase is comprised of licensed A3 premises. There has
been a net increase of 12 A3 granted licences: ten are restaurant/bars and the remaining
two, belonging to licensed cafes (St James’s Caffe, Pall Mall and Itsu, Picadilly), are a
new phenomenon in the area since 1999. In Class A4 premises, there are two additional
A4 bar/wine bars and of note is the constant number of public houses; the core of St
James’s seems to be resisting the wider trend for closures of public houses. There has
been a significant proportional decline in nightclubs – a loss of two licensed premises
(decrease by two-thirds).
3.9.
As was the case for the 1999 study area, there has been no change in the number of C1
hotels or in sui generis private members clubs.
3.10.
Each of the seven licensed Class A1 shops gained their licences since 2005.

3.8.
The wider study area shows broad continuity since 2005 in the trends described above.
The total number of licensed addresses has increased by three. There has been a net
increase of one licensed restaurant/bar and three cafes (A3) either licensed or with
licence applications in progress, and three bar/wine bars (A4). However the number of
licensed restaurant/bars recorded does not accurately reflect the growth trajectory of this
Use Class since new developments in progress in the east of the study area, when
complete, will reinstate several premises’ licences which had expired at the time of this
study. Thus a larger net increase in A3 licensed premises is anticipated.

3.11.
A3 restaurant/bar, A1 shop and C1 hotel premises are concentrated on the main streets:
St James’s Street, Jermyn Street, Piccadilly, Regent Street St James’s, and a particularly
large number on Haymarket. By contrast, A4 public houses are found on relatively minor
streets. Private members clubs are concentrated on Pall Mall, Park Place and around St
James’s Square. Cafes (A3) and bar/wine bars (A4) are scattered across the area.
Change Since 1999
3.12.
Assessment of spatial change since 1999 must be limited to the 1999 study area which is
considerably smaller than the 2005 and 2015 study area. This means it excludes the area
of Haymarket/Regent Street St James’s, where there has been significant change
(Paragraph 3.14) and a concentration of A3 restaurant/bar premises.
3.13.
Considering the 1999 study area only, change has mainly occurred at the north, northeastern and western edges of the area. The north has seen growth in licensed premises,
with seven additional licences and one licence pending decision along Piccadilly (all Class
A3). The other areas of change have seen a net decline in licences: the western edge
along St James’s Street saw three new licences (two A4, one sui generis) but four
closures (A3, A4, C1 and sui generis), whilst one additional Class A3 licensed premises
was more than offset by the loss of three Class A3 licensed premises in the Duke of York
Street area in the north-east. There was one new licence, a café (St James’s Caffe), on
Pall Mall.
Change Since 2005
3.14.
Change and growth in licensed uses since 2005 has been largely concentrated in the
eastern part of St. James’s. There are seven new licensed premises (six A3, one A4) in
the Regent Street St James’s – Haymarket area. When complete, the St. James’s Market
development affecting Haymarket, Regent Street St James’s and Norris Street, will also
reinstate A3 uses (restaurants/bars) where licences are at present expired.
3.15.
Piccadilly, the northern boundary of St. James’s, is the other location where growth has
been concentrated since 2005. There are three new A3 licences along the street, with one
further Class A3 licence pending decision.
3.16.
By contrast, all six licences lost since 2005 (two A3, two A4 and two sui generis
nightclubs) were located in the western and central areas of St. James’s: St James’s
Street and just south of Jermyn Street.

Opening Hours
3.17.
Licensed opening hours of premises at 47 addresses within the 1999 study area have
increased since 1999. The number of premises licensed to remain open later than
midnight has more than doubled, from 14 to 30, since 1999.
3.18.
The increase in licensed opening hours is partly an outcome of the 2003 Licensing Act5,
known as the '24 hour drinking law', which came into force in November 2005. The Act
established flexible opening hours for licensed premises and integrated single premises
Licences. A 2007 survey of 45,000 licensees found that after the introduction of the Act
public houses closed on average 27 minutes later, registered clubs 56 minutes later and
nightclubs 31 minutes later6.
3.19.
Further to licensed opening hours, Temporary Event Notices can be made for the use of a
premises to provide licensable activities for a limited period of time. These frequently
involve an extension of opening hours beyond regular licensed hours. The City of
Westminster Licensing News report7 for the week commencing the 2nd November 2015
alone shows that a total of six Temporary Events Notices were submitted. For example,
the Gaslight of St James’s (Duke of York Street), which submitted a notice for the
continuation of normal operation of the premises beyond the usual time of 03:00 AM until
04:30 AM. The ability of licensed premises to extend opening hours in this way must be
taken into account when considering their impact on the character of St James’s.

Conclusion
4.1.
Licensed food and drink premises in St James’s are dominated by A3 restaurant/bar
premises located on the area’s main streets: Piccadilly, Jermyn Street, St James’s Street,
Regent Street St James’s and Haymarket. The traditional private members clubs also
make a significant numerical contribution to licensed premises, and tend to be located in
the southern and central parts of the area, on Pall Mall, Park Place and around St
James’s Square.
4.2.
Comparison with the 1999 and 2005 databases has revealed the following trends:
1) Uses
 Proliferation of A3 restaurant/bar premises and new phenomenon of cafes (A3) and
shops (A1) seeking licences for alcohol consumption on premises.
 Relatively stable A4 (public house, bar/wine bar), C1 (hotel) and private members
club (sui generis) numbers.
 Decline in nightclub premises (sui generis Use Class).
2) Spatial
 Greatest changes are taking place at the northern and eastern edges of the wider
study area: Piccadilly, Haymarket and Regent Street St James’s.
3) Opening hours
 Increase in overall licensed opening hours and instances of licensed late opening.

Notes on the Database
4.3.
Table A-1 is a database of licensed premises in St James’s compiled through a desk-based study of Westminster City Council’s licensing register and an on-site survey visit undertaken in
November 2015. The licensing information is up to date as of 5th January 2016.
4.4.
Licensed premises are listed by street address. Streets are ordered alphabetically and individual premises are listed in ascending street number order.
4.5.
‘Late Night Refreshment’ refers to the provision of hot food or hot drink to the public for consumption on or off the premises between the hours of 11:00 PM and 05:00 AM. It excludes supply to
guests of hotels or recognised clubs.
4.6.
As mentioned in the report (Paragraph 2.7), the 2015 opening hours information concerns licensed (i.e. maximum) opening hours. The 2005 opening hours information in the database generally
refers to premises’ actual opening hours, apart from where ‘permitted hours’ are given. As such, the 2005 opening hours are provided for information rather than to allow definitive comparisons to
be made.
